Should I beat this kid up?

Ok, in art cl there is this wayyyy annoying kid. On the first day of school My art teacher (who is very cool) was saying something in the front of the clroom. I was sitting close to were the teacher was talking. About 2 rows behind me there was tis **** called "Jordan". He would not be quiet when the teacher would ask him. It was annoyin EVERYONE. So later on that week we had an ignment to do in cl. The stupid kid rolled up to me in his chair, and started saying such dumb stuff. I finally got tired of it and stood up and said "go back to your seat you little ******" (sorry for my language, please dont report as this is a serious issue...). I am a large 16 year old. He is a little 15 year old that looks like he should be in 8th grade. He quickly went back to his seat. Well months went by, and he didnt do anything to me. Until the kid threw something at me and it hit my in the face. I told myself I was going to kick his *** after cl, and he knew I was going to. When the bell rang he ran to the parking lot, and I just let him go. Well today I heard him say the full on "N" word, this infuriated me. Its white kids like him that get white kids like me jumped... anyway, I then heard him call this girl in the cl a "C" word. This made me even more angry. The girl he called the c word has no friendsin that cl and I feel really bad for her. I wanted to take him, push him over the desk, and slam his head into the wall. No one appreciates this kid, so should I just take a suspension and give everyone a favre and kick his ***? Thanks ahead of time. Also could I get sued?
